Estinzione del rapporto di lavoro nel nuovo CCNL

La parte che risolve il rapporto di lavoro senza l’osservanza dei termini è tenuta a corrispondere all’altra parte un’indennità pari a...

Art. 85 Termination of the employment relationship

Notice periods:

- 2 months for employees with up to 5 years of service

- 3 months for employees with up to 10 years of service

- 4 months for employees with more than 10 years of service.

The notice periods start from the first or the sixteenth day of each month.

Note, when it is the employee who resigns, the years are halved.

So if you have worked for less than 5 years and you are the one requesting the notice you will only have to give one month's notice, which starts either on the first or the 16th of each month. For example, if you request notice on December 2, the count will start on December 16. My advice is to have your holidays, hours, and time off calculated and try to use them up before requesting notice.

The party terminating the employment relationship without observing the notice period is required to pay the other party an indemnity equal to the amount of salary due for the period of missed notice.

Holidays cannot be assigned during the notice period.

The notice period is counted towards seniority for all purposes.
