
With the entry into force of the 2025 Budget Law (L. 207 of December 30, 2024), new provisions have been introduced regarding parental leave and the related economic treatment. In particular, art. 1, paragraph 217, of the aforementioned law amends art. 34, paragraph 1, of Legislative Decree 151/2001, providing for an improvement in the allowances granted to working parents. For periods of parental leave taken up to the twelfth year of the child's life, each parent is entitled to 3 non-transferable months with an allowance equal to 30% of salary. Furthermore, alternatively between parents, the following is provided: an increase to 80% of salary for a total maximum of 2 months, if used within the sixth year of the child's life (or within 6 years from entry into the family in case of adoption or fostering); It should be remembered that, according to the current contractual regulations (e.g. art. 60, paragraph 3 CCNL Health Sector – 02/11/2022, art. 41, paragraph 3 CCNL Health Area – 23/01/2024, art. 17, paragraph 3 CCNL Local Functions – 16/07/2024), the first month of parental leave is already paid at 100%. The new state regulation integrates this treatment for the following months. For those who finish maternity/paternity leave after December 31, 2023: 1st month: 100% 2nd month: 80% From the 3rd month: 30% For those who finish maternity/paternity leave after December 31, 2024: 1st month: 100% 2nd and 3rd month: 80% These new measures apply only to parents who finish, even for just one day, the compulsory leave after December 31, 2024. For those who have completed leave by 2024, the previous indications remain valid, as per the Notice of June 14, 2024.
