Request for Amendment to the Procedural Methods for the Functioning of Leave Nursing Up Romagna, always committed to solving the numerous problems of the Company, intends to propose a modification to the current procedural methods for managing leave. In particular, reference is made to point C) 3 paragraph, where it is specified that "leave cannot be used for asynchronous recorded lessons that can be accessed by the employee at any time and hour." We believe that this provision, as formulated, is discriminatory for many employees who could benefit from what is provided for in the contract. In this regard, the recent ARAN opinion CFL258 has clarified that attending online university courses, even if asynchronous, does not prevent the possibility of using the 150 hours of leave to take – in person – the profit exams, as established by paragraph 4 of art. 62 of the CCNL 02.11.2022. In light of the above, we request: The correction of the text of the notice, integrating the reference to the ARAN opinion, which clarifies the legitimacy of using leave also for online university courses with asynchronous lessons. The possibility of including an hourly quota in point C of the notice, intended for asynchronous lessons. This quota must be justified by the university administration, should the lessons coincide with the employee's working hours. The prior verification, at the time of the application for access to the notice, to establish whether the lessons are entirely asynchronous or in mixed mode, in order to correctly activate the benefits provided.
