The Constitutional Court, with ruling no. 99/2024, declared the constitutional illegitimacy of art. 42bis, paragraph 1, of legislative decree 26 March 2001, no. 151 (Consolidated Law on legislative provisions regarding the protection and support of maternity and paternity, pursuant to article 15 of law 8 March 2000, no. 53), in the part where it provides that the temporary transfer of a public employee, with minor children up to three years of age, may be arranged "to a service location situated in the same province or region in which the other parent carries out their work activity," instead of "to a service location situated in the same province or region in which the family residence is located or in which the other parent carries out their work activity." This change guarantees greater flexibility and more concrete support for families in which both parents work in different regions. Nursing Up has always supported the importance of supporting the family and the right of parents to reconcile work with childcare. The victory of parents before the Constitutional Court is further confirmation of the union's commitment to protecting the rights of its members. The 2019-2021 Healthcare CCNL provides that companies give priority to voluntary mobility requests for serious health needs, reunification with spouse or minor children, and assistance to minor or disabled children and parents. Nursing Up will continue to fight for the recognition of the rights of working parents and for the promotion of the family as a central value of society. Together we can make a difference!
