31/03/2022 approved by the Council of Ministers two important European directives:
- Directive 2019/1158 (work-life balance for parents and caregivers)
- Directive 2019/1152 (on transparent and predictable working conditions in the European Union)
They will be valid after publication in the Official Gazette.
The new directives, in brief, confirm paternity leave, mandatory, lasting 10 days. Usable by the working father within two months before to five months after childbirth, both in the case of birth and perinatal death of the child.
Parental leave, for individual parents will go from 10 to 11 months, value equal to 30% of salary, the coverage of the allowance will increase from 6 to 9 months.
Leave for children under 12, increases from 6 to 12 years.
News also for smart working: public and private employers, will have to recognize priorities:
- for those with children up to12 years of age (with no age limit in the case of children with disabilities, pursuant to Article 3, paragraph 3, L.104.)
- for caregivers, pursuant to Article 1, paragraph 255, of L.205
The worker who requests to use smart working cannot' be demoted, dismissed, sanctioned, transferred or subjected to other worsening organizational measures.
New minimum protections, compared to those already existing, with the promise to ensure that all workers receive clarity on information and conditions of their employment relationship, in writing. Reasonable duration of the probationary period, possibility for the worker to carry out a parallel job outside the established working hours.
New measures aimed at protecting workers in the event of violation of their rights and, in particular, on equal treatment.
Right to appeal, which may include adequate compensation, as well as adequate judicial and administrative protection, protection from dismissal.
The regulation will be valid after publication in the Official Gazette.
