European Regulation 679/2016 has created an organic and advanced framework of rules aimed at identifying the best possible balance between essential human rights such as identity and privacy and the unstoppable expansion of ever-new technological possibilities that satisfy, but sometimes even create, impressive informational and communicative needs.
This regulation represents both an opportunity and a challenge.
It offers precise points of reference in a fluid and ever-changing context, shapes rather effective levels of protection, and adequately takes into account the interests and needs of companies and the market.
At the same time, the Regulation calls upon numerous categories of subjects, among which public institutions play a leading role, and requires attention, responsibility, professionalism, and specialization.
It is also undeniable that European legislation on personal data will require the contribution of various professional groups, particularly those with legal, IT, management, training, and quality certification skills.
An opportunity and a challenge for which it is already time to prepare, under penalty of being excluded from the great race.

In the healthcare sector, we know how stressful it is to be constantly called back to work via mobile phone (direct call or, even worse, with a message on WhatsApp!), especially the "last minute" calls when, often, you are at the table with your family and "someone" calls you to work an afternoon shift while you had planned to go out with your children or friends! But is it always our duty to answer and get ready to go to work as soon as possible?

The only contractual obligation that, at present, healthcare companies and SSN entities have available to trace an employee as quickly as possible and force them to return to work is art 28 Availability > CCNL 21.05.18 which explains the conditions under which personnel subject to this contractual provision must report to work.

For everything else, no one (AUSL/SSN entities and confederate unions) has ever tried to establish clear and concise rules that would guarantee continuity of care in hospitals and the right of employees to enjoy their private life.
