





Art. 45 Weekly Rest
The number of weekly rest days due to each employee is set at 52 per year, regardless of the form of work schedule.
Sundays occurring during periods of absence for reasons other than vacation are not counted.
Weekly rest cannot be waived and cannot be monetized (understood?).
The national holiday and the Patron Saint's day coinciding with Sunday or Saturday for staff with a five-day work schedule do not give rise to compensatory rest or monetization.
If the rest day is missed, it must be made up the following week, on a day agreed upon between the employee and the manager or the head of the department, taking into account service needs.
Work performed on a non-working weekday, as a result of a five-day work schedule, entitles the employee, upon request, to equivalent compensatory rest or to payment for overtime work, or Article 48 (Time Bank) applies.
