Art. 90 Off-site Service
Personnel are considered to be on off-site service when, after having reported for duty at their regular workplace, they are called upon to perform their work activities in other locations temporarily. This applies if at least one of the following two requirements is met:
- the duration of the service is less than eight hours
- the service is carried out within a radius of 50 km from the regular workplace.
If it is more convenient to reach these other locations directly from the usual residence, the round-trip travel time from the workplace to the location where the activity is carried out is to be considered, for all purposes, as working hours. Companies and Entities establish, through the acts provided for by their respective regulations and according to their organizational needs, the conditions for reimbursement of expenses related to the transport of materials and tools needed by personnel to carry out the assigned task.
Art. 91 Travel Allowance
Personnel sent, without first reporting for duty at their workplace, to temporarily perform their work activities in a location different from their usual residence or regular workplace, for a period exceeding eight hours and more than 50 km from the regular workplace, are entitled, in addition to normal pay, to:
- reimbursement of expenses actually incurred for travel by train, plane, ship, and other intercity means of transport, up to the cost of the ticket (economy), for urban means of transport or taxi
- for trips lasting more than twelve hours, reimbursement of expenses incurred for overnight stays in a hotel up to four stars and for two daily meals, within the limit, for said meals, of a total of € 44.26
- for trips lasting not less than eight hours and up to twelve hours, reimbursement for one meal up to € 22.26
- for continuous trips to the same location lasting not less than thirty days, reimbursement of expenses for overnight stays in a tourist hotel residence of a category corresponding to that allowed for hotels, provided it is economically more convenient than the average cost of the permitted category in the same location, pursuant to letter c)
- overtime pay, with the relevant authorizations, in the event that work activities at the business trip location extend beyond the normal working hours for the day, considering, for this purpose, only the actual time worked. Only in the case of drivers is travel time and the time spent supervising and guarding the vehicle also considered working time.
Activities carried out in very particular operational situations which, due to the impossibility of having a meal or overnight stay during the trip because of a lack of facilities and catering services, entail the payment of a lump sum of € 25.82 gross per day.
For the Companies and Entities concerned, these activities, by way of example, are identified as follows:
- civil protection activities in emergency situations
- assistance and accompaniment of patients and the sick during emergency transport or in particular safety conditions
- interventions in particularly disadvantaged areas such as lagoons, rivers, woods, and forests- activities involving short embarkations on units
- activities of control, detection, testing, supervision, verification and inspection, health, labor protection, environmental protection, territory and cultural heritage protection, health protection, fraud repression and similar
- social assistance activities
The employee sent on a business trip pursuant to this article is entitled to an advance of not less than 75% of the total amount presumably due for the trip.
