Art. 53 Leave for women victims of violence
The female worker, included in protection programs related to gender-based violence, duly certified, is entitled to abstain from work, for reasons connected to such programs, for a maximum period of 90 working days of leave, to be taken within a period of three years starting from the date of commencement of the certified protection program.
The application must be made in writing to the employer (unless impossible), attaching the certification proving inclusion in the protection program with at least five calendar days' notice and indicating the start and end of the relevant period.
The economic treatment due to the worker is that provided for maternity leave, by art. 60 (Parental leave).
Valid for length of service, does not reduce vacation days and is useful for the thirteenth month's salary.
The worker can choose to take the leave on an hourly or daily basis.
from full-time to part-time, as provided for by art. 74 (Working hours for part-time staff).
The part-time contract is converted into a full-time employment contract, at the worker's request.
The employee who is a victim of gender-based violence and included in specific protection programs may apply for transfer to another Operational Unit/Service/Structure of the same Company or Entity or to another public administration located in a different place from where the violence occurred, after notifying the Company or Entity of affiliation.
Within fifteen days of the request, the Company or Entity of affiliation arranges the transfer, provided there are vacant positions corresponding to her area.
This leave is cumulative with leave of absence for personal or family reasons for a further period of thirty days, unless there are specific service needs.
The employee, at the end of the protection program and after returning to work, may request to be exempted from inconvenient shifts, for a period of one year and/or to return to the Company or Entity where she originally worked or to the Operational Unit/Service/Structure of origin.
