Art. 44, The on-call service (Reward fund and working conditions) is characterized by the immediate availability of the employee and the obligation for the same to reach the facility within the prescribed time according to the procedures established by the companies or entities and emergency plans.
No abuse of on-call service should be made, the number must be strictly necessary to meet the functional needs of the operational unit itself.
The on-call service is normally organized using staff from the same operational unit/service, however taking into account the characteristics of the service to be provided and the reference territory.
It should be limited to night shifts and holidays, ensuring weekly rest. In the event that it falls on a holiday, at the request of the worker, an entire compensatory rest day is also due without reducing the weekly hourly debt.
In case of call, these hours are paid as overtime or, in case of participation in the hour bank, article 48 (Hour bank) applies.
On-call service normally lasts twelve hours and entitles to an hourly allowance of euro 1.80 gross, possibly increased during supplementary bargaining.
Two on-call shifts of twelve hours each are only possible on holidays.
On-call staff called into service, resulting in the suspension of the eleven hours of rest, must recover it immediately and consecutively after the service rendered; if, in exceptional cases, it is not possible to recover it, the hours of missed rest will be taken, in a single solution, within the following three days.
No more than seven on-call shifts per month may be scheduled for each employee.
Excluded from on-call service is administrative staff.
