

From January 1, 2023, overtime pay have been replaced by a new functional allowance, called coordination and professional allowance. The functional allowance amounts to at least 4,000 euros per year.
It seems that some companies have reset to zero as of December 31, 2023 all overtime hours accumulated by their employees before January 1, 2023.

The contract stipulated that from January 1, 2023, the new economic quotas such as *functional allowance* (starting from €4,000) would be paid, which, as defined by the specific Art. 32 of the CCNL, this allowance absorbs the overtime pay!
This obviously and indisputably takes effect from January 1, 2023 in relation to the new quota received by the professional.
The reduction of hours is valid only if the functional allowance exceeds €3,690; for those who received less as of 12/31/2022, the hours should not be deducted.
However, it seems that the company has reset all hours, including those before 01/01/2023, in fact, creating an economic damage that we consider totally against the contract and which is already being handled by our legal office.
