With this letter, the undersigned territorial secretariats of the trade unions Nursind, Nursing Up present the following requests regarding the subject in question:

The activation of the Technical-Assistential Manager on call must be the first action for the U.O. operator on duty.
It is inconceivable to delegate an additional activity, moreover of organizational and higher competence (coordination/R.I.D./D.I.T.) to personnel already engaged in care activities, to pursue a company objective that is not monetized in any way.
· In inpatient and/or outpatient units where the P.D. institution does not exist, the employee's right not to respond to any requests to return to work from the employer is inalienable.
· Where there is a 3x8 or 12-hour shift matrix, a company organizational document cannot institutionalize staying on duty for more than one consecutive shift or interrupting rest, a condition necessary to ensure the employee's psycho-physical recovery.
· The commitment of nursing staff to additional activities of organizational competence, for which the on-call D.I.T. figure has long been identified, must include a hardship allowance.
· The COVID emergency has now surpassed the emergency state of the first phase in which the Company could be considered unprepared; therefore today, beyond the peaks of infection, the Company is obliged to guarantee the replacement rate in every unit. The chronic staff shortage already present before the pandemic can no longer be used as a justification.

. The number of positive operators, although slightly decreasing 447 (data updated as of 22.07), further reduces the replacement coefficient (supplementary staff) already engaged in guaranteeing summer holidays for the sector staff. The use of POA, unfortunately often not granted due to a misleading interpretation of the agreement, is already poorly tolerated due to constant requests for additional shifts that put users and operators at serious risk due to work-related stress.
. Not only are POAs not recognized, but neither are the excess hours; in fact, both overtime payments and any time-off related to the exponential increase in average hours worked by health and technical staff are blocked.
· Therefore, a discussion with the union parties is requested on the matter.
