Three important indications are coming from INPS.

For assistance to an individual with a disability in a situation of severity, the right can be recognized, upon request, to several eligible individuals, who can use it alternately among themselves.

Another new feature concerns extraordinary leave, Art 42, paragraph 5, Legislative Decree 151/2001, which is also due in the case where cohabitation, if required by law, has been established after the leave request, provided it is guaranteed for the entire duration of the leave.

Since August 13, 2022, it is possible to take advantage of the leave in question according to the following order of priority:

- the cohabiting spouse / the cohabiting civil union partner / the de facto cohabitant of the person with a disability;

- the father or mother, even adoptive or foster, of the person with a severe disability, in case of absence, death or in the presence of disabling pathologies;

- one of the children cohabiting with the person with a severe disability in case of impossibility of the above-mentioned subjects;

- one of the brothers or sisters cohabiting with the person with a severe disability, provided that the spouse, parents and children are unable;

A relative or in-law up to the third degree cohabiting with the person with a severe disability, provided that none of the other relatives listed above can take care of the disabled person.

Final indication, the inclusion among the eligible workers, of the de facto cohabitant identified by article 1, paragraph 36, of law 76/2016 which regulates cohabitations and civil unions between people of the same sex.
