Art. 63 Mobility
Voluntary mobility between Companies and Entities is governed by art. 30 of Legislative Decree no. 165/2001.
- mobility takes place in compliance with the area and professional profile of employees in relation to the position to be filled
- the call for applications, to be issued annually and published on the company website, listing the profiles sought by the Company, indicates procedures and evaluation criteria
- participation is allowed for all employees who meet the experience and competence requirements indicated in the call for applications
- mobility does not entail novation of the employment relationship
- the personal file follows the transferred employee
- without prejudice to the fact that the activation of mobility requires the consent of the entity or company of origin, participation in the call for applications also takes place without their prior consent.
The Company or Entity of origin, upon receiving the request for consent, responds with reasons within 30 days.
Companies and Entities give priority to applications for serious and documented health needs, for reunification with spouse or minor children in custody, or for needs related to assistance to minor or disabled children and parents.
Personnel admitted to particular training courses or refresher courses lasting more than one year (postgraduate courses, specialization, management, and master's courses) following the relevant investment plans of the company or entity must undertake not to access voluntary mobility unless two years have passed since the end of the training.
